"Arbitration in Litigation": First Hand Experiences at the SICC
Singapore's reputation as a trusted neutral forum for international dispute resolution in Asia is well-established, reflected by the 2021 International Arbitration Survey by Queen Mary University/White & Case reporting that Singapore (jointly with London) is the most preferred seat for international arbitration globally. Building on this success, the Singapore International Commercial Court (SICC) was established to provide a trio of effective and appropriate dispute resolution options – international litigation as a companion to both international arbitration and international mediation. With its unique structure and flexible procedures, the SICC has been described as “arbitration in litigation”.

Join our distinguished panel as they share first-hand their war stories and practical experiences of conducting litigation in a Court that is uniquely one-of-a-kind - an ‘uncommon’ common law court. They will consider the key advantages of the SICC, including the right of appeal, the ability to join third and related parties, and the significance of the SICC being a source for the development of lex mercatoria, providing guidance to parties in their cross-border dealings.

The panel will also discuss aspects of international best practices which straddle international litigation and arbitration as the SICC continues to innovate further on its flexible rules and procedural features, as well as the SICC in its role as a supervisory court for international arbitration matters seated in Singapore. Lastly, a consideration of new developments that are expected to come into place to better serve the dispute resolution needs of the global commercial community.
